Tipton Case Judge “Courageous�

Judge Sue Bell Cobb set the tone for the oral arguments in Montgomery Tuesday,
ruling Judge Glenn Thompson is “really courageous.� She praised him for
policing the police and the prosecution, and pointed out that the Tipton extra-
marital affairs and things like the destroyed sex toy evidence were serious and we
had to be fair.

Assistant Attorney General Corey Maze made the opening argument and quoted
several laws. Moore attorney Tom Kyle argued for the defense.

Karen Tipton, the wife of affluent psychiatrist Dr. David Tipton, was killed in her
home at 2330 Chapel Hill Road in 1999.  She and her husband have since come
under fire for their lifestyle—so shocking and offensive that anyone could have
killed her, including her husband who was in Huntsville the day of the murder.

Moore was convicted and the judge over-ruled the jury’s recommendation for
life without parole by sentencing Moore to death.  Judge Thompson later threw out
the conviction and ordered a new trial, a decision upheld by the Appeals court.  
Judge Thompson then dropped all charges against Moore and released him.  But
that didn’t stop the state from appealing again and that’s what the oral
argument was about.

A ruling could be months away.
