| Tonight, Douglas Halbrooks of the Decatur Enews site formed a TIPTON TRIAL discussion forum. It opens with over two hundred posts from a bizarre woman (with no bearing on THE STATE OF ALABAMA V DANIEL WADE MOORE) hysterically attacking me, and telling the most bizarre lies imaginable. Douglas Halbrooks has accused numerous posters--those who challenge the ranting--of misconduct on his forum. Multiple posters were banned and their posts deleted. Mr. Halbrooks received an email from me two days ago making clear my position on inappropriate, offensive, invasive, defamatory, and illegal posts. What he does or doesn't do in the five days following complaint is key in libel law--particularly with regard to punitive damages. So I don't care what he does--especially considering how much damage they're doing to the other side in the REAL show--SOA v dwm. He can put on the Kubina v Tipton virtual mud wrestling match if he wants--I've warned him against it. But everyone needs to understand they'll be doing it without me. I am not cartman, and I never was. He knows this, if he has IP addresses. But he thinks it's appropriate to have a crazy borderline to carry on weeks of fantasy interactions with me on his "news site." I hold him totally responsible. |
| I noticed the Channel 31 article says the State is appealing the defense motion for acquittal. It's another obvious factual error. Thompson turned down the motion for acquittal. It's Thompson's ruling awarding a new trial and holding the first one for naught that is being disputed by the State. |
| I'm aware of at least four letters to the editor of the Decatur Daily they've not printed in the past three weeks--letters having to do with their sleazy, biased coverage. |
| Victims are expected to wait a lot. I waited a year and a half for DNA testing to be done and the arrest was made. I waited two more years for it to go to trial. I waited two more months for the sentence, and two months later Thompson threw it all out. Four months later, I'm now waiting for Judge Thompson to explain his decision to the CCA, and then I'll wait for the CCA's next ruling. If they deny the state's petition, trial could be as soon as three months, but possibly a lot longer. The average time from death sentence to execution is 15 to 20 years, and includes approximately twenty separate judicial proceedings, any one of which can start the process all over again. After four years and four months, dwm is still in Decatur, and lawyers are fighting over the first step of twenty. |
