In June, Powell filed papers with the Supreme Court of Alabama challenging the Court
of Criminal Appeals' jurisdiction to rule on uh criminal appeals. To quote: " This is
not an authorized appeal...the (appeals) court does not have jurisdiction or authority to
hear it." The Supreme Court unanimously disagreed.
Powell claimed Moore should go free because the Court of Criminal Appeals had not
ruled in a timely fashion. The Supreme Court unanimously disagreed.
Powell continues to say "it IS double jeopardy, in my opinion." The Court of
Criminal Appeals unanimously disagrees.
Now that Powell has made claims of misconduct on the part of the appeals courts
regarding jurisdiction and timeliness, he has apparently filed his latest appeal after the
filing deadline and with the wrong court.
Powell's latest motion was rejected by the Court of Criminal Appeals.
