| February 10, 2005 Dear Mr. Tipton: The following comment is the one with which I am taking issue: xxxxxxxxxx xxx xxxxx xxx xxxxxxxxxxx xxx xxxxxxxxxx xx xx xxxx xxxx xxxxxxx xxxxx xxxxx xxx xxxxxx xx. At no time have I EVER encouraged ANYONE to harass you, nor do I know of any of my relatives who have done that. I can't believe that you would put a statement such as this on your website without first contacting me to determine the truth. I am sorry for what happened to your wife. But for you to take out your anger and resentment on an innocent person is just not right. I have never met you, nor have I ever spoken to you. Yet you felt it necessary to libel and slander my name on your website because you were apparently angry. I can assure you that I have never told anyone to libel and harass you. First it is against all my moral principals and second, it would be illegal. I challenge you to find ANY PERSON who would tell you that I have encouraged them to do anything immoral and/or anything illegal. As I stated previously, I am requesting that you remove my name from your website and failure to do so will result in the appropriate legal action to have my name removed from your website and all other legal remedies available to me under Alabama law. | February 12, 2005 Dear Rebecca Farris: Thank you for clarifying your threat. I have deleted the sentence you find so offensive. However, the fact remains that the "decaturenews" forum contained hundreds of libelous posts over an extended period of time. It also contained illegal posts, such as direct quotes from protected, confidential documents sensitive to a capital murder trial. If you are so indignant about just having your name on my website, perhaps you should consider that the teenagers you were assisting legally were libeling and harassing me on a grand scale. I assumed you would have some knowledge of the content of their site. I further assumed your brother, Dwight Jett II, would be aware of what his son was doing on the Internet. Ignorance is hardly an excuse for failure to adequately supervise a minor. I have better things to do than take civil action against Linda Kubina, two irresponsible teenagers and their handlers. But if you want to have a battle with me, I'll give you one. Dr. David Tipton, M.D. |
